5.10. Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.
6. ORDERS
6.1. Customers may place orders through the online store by following the ordering process displayed on the website.
6.2. Submitting an order constitutes an offer to purchase the selected products.
6.3. An order is subject to:
a. product availability;
b. successful payment or approved payment arrangement;
c. verification where reasonably necessary; and
d. acceptance by Nkosi's Natural Beauty.
6.4. An automated order confirmation does not necessarily constitute final acceptance of the order where the transaction is subject to further verification.
6.5. We reserve the right to refuse or cancel an order where:

6.6. Where an order is cancelled by us after payment has been received, any refund due to the customer will be processed in accordance with applicable law and our Refund Policy.

7.1. All prices displayed on the website will be stated in South African Rand (ZAR), unless otherwise indicated.

10.2. Nothing in our Refund and Returns Policy is intended to remove or restrict any mandatory consumer rights.
10.3. Where legislation provides a consumer with a right to cancel a transaction, return goods or receive a refund, those rights will apply.
10.4. Where a product is defective, unsafe, damaged or materially different from what was ordered, the customer may have statutory remedies.
10.5. Products returned for hygiene and health reasons may be subject to lawful limitations where applicable, particularly where the product has been opened or used, provided that such limitations are consistent with applicable consumer law.

10.7. Refunds will generally be made using the original payment method where reasonably practicable.
11. DAMAGED OR INCORRECT PRODUCTS

11.3. We reserve the right to investigate the circumstances surrounding a reported problem before determining the appropriate remedy, subject always to the customer's statutory rights.
11.4. Where the company is responsible for an error, the appropriate remedy will be provided in accordance with applicable law.
12. CUSTOMER RESPONSIBILITIES

13. RESELLER AND WHOLESALER PROGRAMME
13.1. Nkosi's Natural Beauty may offer a reseller and/or wholesaler programme.
13.2. Submission of a reseller or wholesaler application does not automatically guarantee approval.
13.3. We reserve the right to approve or reject applications subject to applicable law and our internal business requirements.
13.4. Approval may be subject to:
a. verification of applicant information;
b. acceptance of reseller terms;
c. minimum order requirements;
d. payment requirements;
e. territory or distribution considerations; and
f. other reasonable commercial requirements communicated to the applicant.
13.5. A reseller is an independent business/customer and is not an employee, agent, partner, franchisee or legal representative of Nkosi's Natural Beauty unless expressly agreed in writing.
13.6. A reseller may not represent that they are authorised to bind Nkosi's Natural Beauty to any contract, warranty, representation or obligation unless expressly authorised in writing.
13.7. Resellers may not:
a. make false or misleading claims about our products;
b. make medical claims that we have not authorised;
c. alter, dilute, relabel or tamper with products;
d. remove product information or safety information;
e. misuse our trademarks, logos or marketing materials;
f. engage in deceptive advertising;
g. represent themselves as the owner of the Nkosi's Natural Beauty brand; or
h. engage in conduct likely to damage the reputation of the company.
13.8. We reserve the right to suspend or terminate reseller approval where a reseller materially breaches applicable reseller terms or engages in conduct that creates material legal, regulatory or reputational risk.
13.9. Termination of a reseller relationship does not automatically extinguish rights or obligations that accrued before termination.
14. INTELLECTUAL PROPERTY
14.1. Unless otherwise stated, all intellectual property appearing on the website belongs to or is licensed to Nkosi's Natural Beauty.
14.2. This includes, without limitation:
a. the Nkosi's Natural Beauty name;
b. logos;
c. trademarks;
d. product names;
e. product descriptions;
f. photographs;
g. graphics;
h. website design;
i. written content;
j. marketing materials;
k. videos;
l. slogans; and
m. other proprietary materials.
14.3. You may not reproduce, modify, publish, distribute, sell, licence or commercially exploit our intellectual property without prior written permission.
14.4. Nothing in these Terms transfers ownership of intellectual property to a customer or reseller.
14.5. Any unauthorised use of our intellectual property may result in legal action.
15. CUSTOMER-GENERATED CONTENT
15.1. Customers may occasionally submit reviews, photographs, testimonials, comments or other content.
15.2. By submitting content, you confirm that:
a. you own or have the necessary rights to submit the content;
b. the content does not infringe another person's rights;
c. the content is not unlawful, defamatory or misleading; and
d. the content does not contain confidential information that you are prohibited from disclosing.
15.3. Subject to applicable law and our Privacy Policy, you grant Nkosi's Natural Beauty a non-exclusive, royalty-free licence to use, reproduce and display submitted content for legitimate business, marketing and promotional purposes.
15.4. We may remove content that is unlawful, misleading, offensive, defamatory, fraudulent or otherwise inappropriate.
16. REVIEWS AND TESTIMONIALS
16.1. Product reviews must reflect genuine customer experiences.
16.2. Customers may not submit fraudulent reviews or reviews designed to manipulate our reputation or another business's reputation.
16.3. We reserve the right to moderate or remove reviews that breach these Terms or applicable law.

24. INDEMNITY
24.1. To the extent permitted by law, you agree to indemnify Nkosi's Natural Beauty against losses, claims, damages and reasonable costs arising from your:

b. breach of these Terms;
c. fraudulent activity;
d. infringement of third-party intellectual property rights;
e. misuse of our products;
f. unauthorised representations made on behalf of Nkosi's Natural Beauty; or
g. violation of applicable law.
24.2. This indemnity does not apply to the extent that the loss resulted from conduct for which Nkosi's Natural Beauty is legally responsible.
25. FORCE MAJEURE

26. FRAUDULENT TRANSACTIONS
26.1. Nkosi's Natural Beauty reserves the right to investigate transactions that appear suspicious, fraudulent or unlawful.
26.2. Where permitted by law, we may suspend processing of an order while verification is undertaken.
26.3. We may cancel a transaction where fraud or unlawful conduct is reasonably suspected, subject to applicable legal obligations.
26.4. We may cooperate with law-enforcement agencies, payment providers and other relevant parties in relation to suspected fraud.
27. DISPUTE RESOLUTION

29.1. Nkosi's Natural Beauty may update these Terms from time to time.
29.2. The updated version will be published on the website.
29.3. The version applicable to an order will generally be the version in effect at the time the transaction was concluded, subject to applicable law.
29.4. Continued use of the website following publication of updated Terms may constitute acceptance of the updated Terms to the extent permitted by law.
30. SEVERABILITY
30.1. If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed or interpreted to the minimum extent necessary.
30.2. The remaining provisions will continue to apply.
31. NO WAIVER
31.1. A failure or delay by Nkosi's Natural Beauty to enforce any provision of these Terms does not constitute a waiver of that provision.
31.2. Any waiver must be made in writing where required.
32. ENTIRE AGREEMENT
32.1. These Terms, together with the Privacy Policy, Refund and Returns Policy, Shipping Policy and any applicable reseller/wholesaler agreement, constitute the applicable agreement governing the customer's use of our services and purchase of products.
32.2. In the event of a conflict between these Terms and mandatory South African legislation, the applicable legislation will prevail.
